Modification of Parenting Time

Parenting time can be modified by the court on request by either party at any time if the court finds a modification to be in the best interest of the child. However, if a previous court order regarding parenting time is already in place, the court will favor maintaining that order unless a specific exception is established.

A court will not consider a request to modify parenting time within two years after ruling on a prior motion to modify unless:

• the parties agree to the modification,
• the child is in physical or emotional danger, or
• the party with the majority of the parenting time plans to relocate.
